-All items are sold “AS IS, WHERE IS, with NO WARRANTY expressed or implied

-Most items sold are in used condition which means items probably have imperfections

-No items will leave the Auction House of Broadway without a paid receipt. If someone other than yourself is picking up your items, please be sure a copy of your paid receipt is present

-Items are described as accurately as possible. Description is based on the opinion of the Auction House of Broadway. Items are untested unless otherwise noted. Attending a preview is the best way to ensure the item of interest meets your expectations.

-Not responsible for accidents caused by customers, patrons during any part of the auction process

Terms and Conditions pertaining to payment and pick up listed in the auction description take precedence.

Bidding:

In order to bid on an item, you must be registered and accept the terms and conditions of the specific auction.

Please read over all auction information prior to placing a bid.

All bids are final. We cannot retract or remove a bid.

Any customer information obtained by the Auction House of Broadway will remain private unless permission given to disclose

Payment:

The Auction House of Broadway requires payments be made within 24 hours of the auction ending. Bidding privileges may be revoked with failure to do so.

A 13% buyer’s premium (plus state and local tax) will be added to each purchase.

Payment can be made with a credit or debit card (Visa, MasterCard, and Discover) using the online payment link found in the email notification received upon winning.

Payment will also be accepted at the pickup location.

A buyer wishing to regain bidding privileges may be charged a $25.00 reactivation fee

Preview:

A preview will be available once a week for potential buyers to visit the Auction House of Broadway to examine items. Potential buyers are highly encouraged to attend a preview in order to ensure the item(s) of interest meet or exceed expectations.





 

Pickup:

All items must be removed within 2 business days of the auction end date

Any items not removed within 2 business days will become the property of The Auction House of Broadway (unless other arrangements have been made).

BUYERS WILL BE CHARGED A $5 DISPOSAL FEE FOR NOT PICKING UP ITEMS. THIS FEE MUST BE PAID OR THE BUYER IS SUBJECT TO BIDDER TERMINATION

If you are unable to make the pickup time please contact The Auction House of Broadway at 540-810-6942 or auctionhouseofbroadway@gmail.com. Items MUST be paid in full to qualify for storage.

 

For Onsite Auctions:

Items must be removed within 2 days or item(s) become property of the Auction House of Broadway. (Unless other arrangements have been made with property owner and Auction House of Broadway)

Onsite Pickup:

No items leave the property without full payment and contact with The Auction House of Broadway

Firearm Sales:

Bidder must be eligible to purchase a firearm under local, State, and Federal guidelines.

 

Extended Time Closing:

To ensure all bidders have a fair opportunity to win items, The Auction House of Broadway will use the extended bidding method. If an auction is in the final minute and a bid is placed, the auction will be extended by 1 minute. This will continue until no bids are placed within the final minute. Once this has been achieved, the auction will end and the item sold to the highest bidder.

 

Bid Notification:

If you have been outbid you will be notified by email or phone notification (app users) ONLY UNTIL the last 5 minutes of the item scheduled closing time.

Winning Bidder Notification:

You will be contacted by email or phone notification (app users).

Listing Error:

Please contact The Auction House of Broadway if you believe a listing contains an error. The Auction House of Broadway will assess the concern and make corrections if needed.

 

Abandoned Items

After an item has been determined to be abandoned, the auctioneer assumes full rights of the item and do what he wishes. The buyer Of an abandoned item agrees to pay all fees Associated with the item.

Delinquent Accounts:

The registered user of a delinquent account agrees to be responsible for any fees associated with the account.

Technical Difficulties

If technical difficulties occur at any time during an auction, the Auction House of Broadway reserves the right to end, restart or make any other changes necessary.

Liability:

Auctioneers and Sellers are only liable up to the bidders purchase price.

Limitations:

The above-stated Conditions of Sale cannot be altered except in writing by The Auctioneer.
